fa واکاوی دلایل ادعای امارات متحده عربی مبتنی بر اصل تصرف موثر در موضوع جزایر سه‌گانه ایران عمومى General پژوهشي Research <p dir="rtl">چکیده</p> <p dir="rtl" style="text-align: justify;">جزایر سه‌گانه خلیج فارس (تنب بزرگ، تنب کوچک و ابوموسی) به‌عنوان بخشی حیاتی از قلمرو جمهوری اسلامی ایران، از دیرباز در مرکز توجه ژئوپلیتیک و حقوق بین‌الملل قرار داشته‌اند. امارات متحده عربی با استناد به اصل تصرف مؤثر (Effective Occupation)، ادعای مالکیت این جزایر را مطرح کرده و تلاش دارد این ادعا را از منظر حقوق بین‌الملل تقویت کند. این پژوهش با هدف بررسی دقیق ادعاهای امارات و تحلیل شواهد ارائه‌شده توسط این کشور، اصل تصرف مؤثر را در چارچوب معیارهای حقوقی و پرونده‌های مشابه بین‌المللی مورد ارزیابی قرار می‌دهد. یافته‌های این پژوهش نشان می‌دهد که ادعای امارات فاقد شواهد کافی برای اثبات اعمال مستمر و مؤثر حاکمیت بر جزایر سه‌گانه است. شیوخ محلی شارجه و رأس‌الخیمه نه‌تنها از ابزارهای لازم برای اعمال کنترل عملی برخوردار نبوده‌اند، بلکه فعالیت‌های آنها، نظیر جمع‌آوری مالیات یا صدور مجوزهای اقتصادی، محدود و پراکنده بوده است. در مقابل، ایران با ارائه شواهد تاریخی قوی، حضور مداوم نظامی و اداری و پذیرش بین‌المللی، معیارهای تصرف مؤثر را به‌طور کامل برآورده کرده است. نتیجه‌گیری این پژوهش حاکی از آن است که اصل تصرف مؤثر به‌جای تقویت ادعای امارات، حاکمیت ایران بر جزایر سه‌گانه را تثبیت می‌کند. این تحلیل ضمن نقد ادعاهای امارات، تأکید می‌کند که ایران باید با استناد به اصول حقوق بین‌الملل و شواهد تاریخی، حاکمیت خود بر این جزایر را در مجامع بین‌المللی به‌طور مستمر تقویت کند.</p> <p dir="rtl">&nbsp;</p> <p>Abstract</p> <p>&nbsp;</p> <p style="text-align: justify;">The three Persian Gulf islands (Greater Tunb, Lesser Tunb, and Abu Musa), as an integral part of the Islamic Republic of Iran&#39;s territory, have long been at the center of geopolitical and international legal debates. The United Arab Emirates, invoking the principle of Effective Occupation, has claimed sovereignty over these islands and seeks to strengthen its position through international legal arguments. This study critically examines the UAE&rsquo;s claims and analyzes the evidence presented by the country within the framework of the principle of Effective Occupation and comparable international cases. The findings reveal that the UAE&rsquo;s claims lack sufficient evidence to demonstrate continuous and effective sovereignty over the three islands. The local rulers of Sharjah and Ras Al Khaimah neither possessed the tools for practical control nor established continuous authority. Their activities, such as collecting taxes or issuing economic permits, were sporadic and insufficient. Conversely, Iran has presented robust historical evidence, maintained continuous military and administrative presence, and garnered international recognition, fully satisfying the criteria of Effective Occupation. This study concludes that the principle of Effective Occupation, rather than supporting the UAE&#39;s claims, solidifies Iran&rsquo;s sovereignty over the three islands. It emphasizes that Iran, through reliance on international legal principles and historical evidence, must continue to assert its sovereignty over these islands in international forums to counter baseless claims effectively.</p> واژگان کلیدی: جزایر سه‌گانه, ادعای مالکیت, حقوق بین‌الملل, اصل تصرف.
